Data protection declaration
The Food Cluster at the Kompetenzzentrum für Ernährung processes personal data in various areas in order to perform public tasks and inform citizens.
The following explanations under Part A – General Information – apply to all data processing operations of the Food Cluster.
Specific data protection information can be found in Part B – Special Part.
A) General information
This data protection declaration applies to all persons who contact or stand in contact with the Food Cluster or use its services, including the users of the websites and other online services of the Food Cluster, unless more specific information is given in the specific case (see Part B and information sheets, forms, etc.). Third parties (e.g. online platforms such as Facebook or YouTube, which are linked on our websites) may also process personal data. This data protection declaration does not apply to such third parties or their services. The Food Cluster cannot take any responsibility for how these third parties may use the personal information they collect. For the processing of personal data and information about the data protection practices of third parties, reference is made directly to them. Purposes and legal bases for the processing of personal data
The purpose of the processing is to fulfil the public tasks assigned to us by law, in particular to inform the public.
Unless otherwise stated, the legal basis for the processing of your data results from Art. 4 (1) BayDSG in conjunction with Art. 6 (1) lit. e GDPR. Accordingly, we are permitted to process the data required to fulfil a task incumbent upon us.
If you have consented to a processing, the data processing is based on Art. 6 (1) lit. a GDPR.
Categories of recipients of personal data
To fulfil our contractual and legal obligations, we also make use of external service providers, in particular as contract processors (e.g. IT service providers).
In addition, we transmit personal data to other authorities and courts in order to fulfil legal obligations.
Duration of storage of personal data
Your data will only be stored for as long as is necessary for the performance of the task in compliance with statutory retention periods.
Your rights
As far as we process your personal data, you are entitled to the following rights:
- If your personal data are processed, you have the right to obtain information about the data stored about your person (Art. 15 GDPR).
- Should incorrect personal data be processed, you have the right to correction (Art. 16 GDPR).
- If the legal requirements are met, you can demand that the processing be deleted or restricted (Art. 17 and 18 GDPR).
- You have the right to object to the processing of your personal data at any time for reasons arising from your particular situation (Art. 21 GDPR).
- If you have consented to the processing or a data processing agreement exists and the data processing is carried out using automated procedures, you may be entitled to data portability (Art. 20 GDPR).
- Right of revocation with consent: If you have consented to the processing and the processing is based on this consent, you can revoke the consent at any time for the future. The legality of the data processing carried out on the basis of the consent up to the revocation is not affected by this.
Right of appeal to the supervisory authority
Furthermore, there is a right of appeal to the Bavarian State Commissioner for Data Protection.

B) Special Part
Internet service of the Food Cluster
Recording
When you call up these or other Internet pages, you transmit data to the web server via your Internet browser.
he following data is recorded during an ongoing connection for communication between your Internet browser and the Web server:
- Date and time of the request
- Name of the requested file
- Page from which the file was requested
- Access status (file transferred, file not found, etc.)
- Web browser and operating system used
- complete IP address of the requesting computer
- amount of data transferred
For reasons of technical security, in particular to prevent attempts to attack the web server, this data is stored. Legal basis: Art. 4 (1) BayDSG 2018; Art. 6 GDPR. After seven days at the latest, the data is anonymised at domain level by shortening the IP address so that it is no longer possible to establish a reference to individual users. The data are processed exclusively for this purpose and in anonymous form for statistical purposes; they are not compared with other databases or passed on to third parties, even in extracts.
Cookies
When you access this website, cookies (small files) are stored on your hard disk with different validity periods. These are used exclusively to recognize you during this and other visits to the website. Legal basis: Art. 4 (1) BayDSG 2018; Art. 6 GDPR.

Newsletter distribution
We distribute our newsletter using the service CleverReach. Provider of this service is the CleverReach GmbH & Co. KG, Mühlenstr. 43, 26180 Rastede, Germany.
After registering for our newsletter, your data will be transferred to CleverReach where it will be stored and processed for the purpose of sending the newsletter. After registration, CleverReach will send you an e-mail asking you to confirm or revoke your registration (“double opt-in”).

Collection of further data
The offer includes the possibility to enter personal or business data. Your data will be encrypted during transport using software (SSL) and are protected against unauthorized access by third parties.
When ordering publications, your address will only be used for this purpose. Legal basis: Art. 4 (1) BayDSG 2018; Art. 6 GDPR. Alternatively, the order can also be placed by telephone and/or post. Personal or business data for ordering purposes will be deleted after three years at the latest.
Electronic mail (e-mail)
Information that you send to us unencrypted by electronic mail (e-mail) may be read by third parties during transmission. As a rule, we cannot verify your identity and do not know who is behind an e-mail address. A legally secure communication by simple e-mail is therefore not guaranteed. We use, like many e-mail providers, filters against unwanted advertising (“SPAM filters”), which in rare cases automatically classify even normal e-mails as unwanted advertising and delete them. E-mails that contain harmful programs (“viruses”) are automatically deleted by us in any case.
If you wish to send us messages worthy of protection, we recommend that you encrypt and sign them in order to prevent unauthorised access and falsification during transmission or to send the message to us by conventional mail. Please let us know if and how we can send you encrypted e-mails to respond to your requests and – if this is not possible – if you agree to an unencrypted e-mail reply to your letter. As part of our press and public relations work, photos and film footage are taken and used at events and dates on which you may be identified. You may object to this. Please use the above mentioned contact data for filing an objection.
